This page provides information and links to the current contractual documents regarding the IBM SmartCloud Enterprise Services. The complete agreement consists of the base IBM SmartCloud Agreement International and multiple Attachments. Please carefully read the terms of this Agreement and its Attachments and referenced documents, some of which may be presented online.
IBM may change the terms for the Services as set forth in the Agreement. You may return to this page at any time or upon receiving notice of a change to view the most current contractual documents. We encourage you to periodically check back to find the latest terms, features and functions IBM offers for these Services.
1. SmartCloud Agreement International
This document is the base agreement, containing general terms for IBM SmartCloud Services.

4. Additional Services Order Form Attachment
This document allows you to customise your IBM SmartCloud Enterprise Services and take advantage of IBMs premium Services options, such as preferred pricing with reserved capacity, VPN Services, premium support Services with an add-on Linux operating system support option or enterprise on-boarding services to assist you in getting started with the services. If one or more of these options are desired, and you did not order these premium Services on-line with your initial on-line order, you can complete this Order Form, print and sign it and returned to IBM.

5. Acceptable Use Policy
IBM's on-line policies for acceptable Internet use are also part of this Agreement and apply for the Services. The policy can be found at www.ibm.com/services/e-business/aup.html.
Next steps
If you are printing and signing a copy of the Agreement and Additional Services Order Form (if ordering any premium Services), please print, review the base Agreement (signature version), and its Attachments. Please then sign the base Agreement, providing requested information, and, if ordering any of the premium Services, make your Services selection, provide the required information, print and sign the Additional Services Order Form.

After IBM receives the signed agreement documents, IBM will confirm that your order is being processed.
Upon acceptance of your order by IBM, you will receive an email that Services are available. Upon initial account activation, you will receive your welcome package and information providing you the details needed to access, log in, and begin using the IBM SmartCloud Enterprise Services.
6. Image Terms Attachments
IBM offers a catalogue with available Images that you will have access to as part of the Services. Image terms reference the applicable IBM or third-party end-user license agreement that governs specific uses for the software that makes up an Image. Image Terms are available on the Image Terms page and are also available from the Image Asset Catalogue and may be viewed at any time.
You are responsible for reviewing any such Image Terms prior to selecting a particular Image.
Images will be provisioned with third-party software operating system software. Use of third-party operating system software is provided in accordance with the applicable third-party agreements. Customer is responsible to go to the third-party websites and review the terms of the operating system software third-party agreements.
- SUSE Linux Enterprise Server version 11.0 software is licensed under the Novell Software License Agreement (60KB)
- Red Hat Enterprise Linux 5.4 software is licensed under the Red Hat Enterprise Agreement
- Microsoft Server software (in all available Operating System Image versions) is licensed under the Microsoft Server License Agreement (click on the language of choice for the Service Provider Use Rights document; locate within the section entitled Licensing Models, subsection entitled Per Processor Product List and navigate to the Windows Server product licensing terms.)
