This page provides information and links to the current contractual documents regarding the IBM SmartCloud Enterprise Services. The complete agreement consists of the base IBM SmartCloud Agreement International and multiple Attachments. Please carefully read the terms of this Agreement and its Attachments and referenced documents, some of which may be presented online.
IBM may change the terms for the Services as set forth in the Agreement. You may return to this page and link to the Agreement at any time or upon receiving notice of a change to view the most current contractual documents. We encourage you to periodically check back to find the latest terms, features and functions IBM offers for these Services.
SmartCloud Agreement International
This document is the base agreement, containing general terms for IBM SmartCloud Services.
Service Description Attachment
This document contains specific details and description for the IBM SmartCloud Enterprise Services.
Charges Schedule
This document provides details on the charges and their effective date for the IBM SmartCloud Enterprise Services.
(Applicable for all IBM direct Services orders. If Services were acquired from an IBM Business Partner, charges are as agreed to with your IBM Business Partner)
Additional Services Order Form Attachment
This form allows you to customize your IBM SmartCloud Enterprise Services and take advantage of IBMs premium Services options, such as preferred pricing with reserved capacity, VPN Services, object storage, premium support Services with an add-on Linux operating system support option or enterprise on-boarding services to assist you in getting started with the services. If one or more of these options are desired, and you did not order these premium Services on-line with your initial on-line order, you can complete this Order Form, print and sign it and return it to IBM.
Next steps
If you are printing and signing a copy of the Agreement and Additional Services Order Form (if ordering any premium Services), please print, review the base Agreement (signature version), and its Attachments. Please then sign the base Agreement, providing requested information, and, if ordering any of the premium Services, make your Services selection, provide the required information, print and sign the Additional Services Order Form.

After IBM receives the signed agreement documents, IBM will confirm that your order is being processed.
Upon acceptance of your order by IBM, you will receive an email that Services are available. Upon initial account activation, you will receive your welcome package and information providing you the details needed to access, log in, and begin using the IBM SmartCloud Enterprise Services.
Acceptable Use Policy
IBM's on-line policies for acceptable Internet use are also part of this Agreement and apply for the Services. The policy can be found at www.ibm.com/services/e-business/aup.html.
SC Terms and Terms of Use Attachments
IBM offers a catalog with available Service Component Software available as Images or within Service Instances that you will have access to as part of the Services. SC Terms provide the terms and reference the applicable IBM or third-party end-user license agreement that governs specific uses for the Service Component Ssoftware that makes up an Image. Terms of Use (TOU) provide the additional terms applicable to Service Instances, including applicable IBM or third-party end-user license agreements for Service Component Software included as part of a Service Instance. SC Terms and TOUs are available on the SC Terms & TOU page and are also available from the Public Asset Catalog and may be viewed at any time.
You are responsible for reviewing any such SC Terms or TOUs prior to selecting a particular Image. Images or Service Instances will be provisioned with third-party software operating system software. Use of third-party operating system software is provided in accordance with the applicable third-party agreements. Customer is responsible to go to the third-party websites and review the terms of the operating system software third-party agreements.
- SUSE Linux Enterprise Server version 11.0 software is licensed under the Novell Software License Agreement (60KB)
- Red Hat Enterprise Linux 5.4 software is licensed under the Red Hat Enterprise Agreement
- Microsoft Server software (all available versions) is licensed from Microsoft to Customer under the Microsoft Server License Agreement found at http://www- 935.ibm.com/services/us/gts/html/microsoft_volume_licensing.html
